Abstract


In last few years, with the gradual development of ecological environmental construction in our country, incidents that people hurt by wildlife have been taking place frequently. These accidents cause physical damages, huge poverty loss, and also the mentally hurt to victims, and also does harms to the wildlife conservation as well as the ecological construction in our country. In contrast with the complete and well-established legislation of wildlife conservation, the law system of compensation for damages caused by wildlife is quite faulty, as most victims cannot get correspond or equivalent compensation at all. The contradictions between human being and wildlife are becoming sharper:one side is the wildlife conservation which is vital to the ecological construction; the other side is the protection of human beings’basic rights. Neither of them could be ignored. How to resolve this dilemma is a pressing task in front of us. This thesis studies this phenomenon in depth analysis by a prospect of ecological civilization. This thesis studies the phenomenon with an in-depth analysis by a prospect of ecological civilization. Through analyzing the contradiction between wildlife conservation and local citizen’s vital interests, several theories about relieving to the damage by wildlife, the author states that the ecological compensation is the best way to relieve people from damages caused by wildlife. Because our country’s current law system of relieving the damages caused by wildlife has a few problems, finally, based upon the analysis of the problems above, and combining the reality of our country, some corresponding protection measures have been put forward in the thesis. The complete and well-establishment compensation legal system is the essential requirement for the construction of ecological civilization and harmonious communist society. It will not only ease the contradiction between human beings and wild animals, but also be of great help for the special ecological legislation in the near future, which will make the communist law system of our country more mature.
