Abstract


Contract interpretation is contract law theory and practice of the most common problems . Contract interpretation , refers to the meaning of the contract and its associated data 's analysis and description. Contract interpretation is a judicial interpretation of the judge discretion interpretation. The essence of the system of contract interpretation is to give judges discretion. Chinese Contract Law expanded the judge's discretion , how to properly exercise judicial discretion has become particularly important . This paper explains the generation from the contract , the purpose, nature and other general theoretical issues , discusses the value of the base contract interpretation , and in the interpretation of the contract is reviewed on the basis of the theory proposed contract interpretation, while the judge 's interpretation of the contract exercise and limits proposed.
