Abstract

In order to promote the resources economy and environmental protection, mold the ecosystem consumption mode, consumer must obey the environmental obligation because the consumer behavior is not only related to self-interest but also related to social public interest. In order to ensure that the consumer can perform the environmental obligation, the consumer behavior should enter legal visual field. the consumer behavior should be constrained by the law. Therefore, this article try to study and build up a set of law system which restricts and guides consumer’sconsumption behavior under environment and resources law, this law system is calledthe green consumption law to be studied in this article.green consumption refers to the consumer (including government, enterprise and individual) purposely purchase and use product or the service conforming to the environmental protection standard.It sparkplugs sustainable consumption which embodies the "ecological-based" consumption concept The consumption institution is the system that realize environmenta protection goal by standardizing the consumer behavior through legal measures. The condition of implementing the green consumption has been basically mature under the current construction of environmental friendly society in China. However, at the present, there still have no specific rules to guide and regulate the consumer green consumption behavior in our country. And there is still a greater randomness in the actual operation. So it is imperative under the situation to establish green consumption system at once.This paper demonstrates the basic principles and the establishing proofs of the green consumption system by expatiating on its generation, its contents, identities and significances. It introduces green consumption practice and the successful legislative experience of the United States, Japan, and E.U. It explores in depth from various respects on government,enterprise and individual In the aspect of government, Government Green Purchase System should be build to Advance Circular Economy,green tax system shuld be perfected, monitoring rules shuod be set up for green consumption.In the aspect of enterprise, Product Certificate System should be strengthen, anti-excessive system should be built. In the aspect of individual, individual has the obligation to choose the green Products.the law of disabling use plastic bags should be carried out on the basic of the law of car-using limit inorder to reduse the white polution.green funeral institutions is nessessary aiming at the huge population in China and the funeral custom is conspicuous waste.these laws will greatly prospects for the green consumption system. Benefit from it, circling economy will develepte quickly and we will win both economy and environmental protection
