Abstract


With the development of China 's legal construction , student v. college of cases continue to occur , which led to people constantly thinking . Our existing laws and regulations are not the provisions of the legal status of public colleges and universities , resulting in the student 's rights have been infringed do not get relief . This leads to unfair society , is not conducive to the healthy development of China 's higher education . Therefore, it is very important for accurate positioning of the legal status of public colleges and universities . Ask questions , analyze problems , problem-solving ideas , analysis of various acts of public colleges and universities , and finally concluded that China 's public colleges and universities also both have the status of civil subject to specific areas within the administrative body position . The thesis is divided into five parts , the first part of the problem leads through three typical cases . Our students v. universities the case began TIAN v. University of Science and Technology Beijing case , the other two cases also caused widespread concern in society . The second part is to summarize the existing law at home and abroad . The existing law judges to decide cases based only understand the existing laws in order to further analyze the problem . The third section describes these three cases , the Court made ??the judgment , and judgment jurisprudence . The fourth part of the various theories on the legal status of public colleges and universities at home and abroad , the theorists of various doctrines make us a more comprehensive understanding of the problem . The fifth part is the analysis and conclusions of this paper that the college in a different legal status in different legal relationships : when colleges and universities in the civil legal relationship of civil subject , when it is in the administrative legal relationship is the administrative legal subjects .
