Abstract


With China's rapid economic and social development and the promotion of urbanization , China's substantial increase in the number of floating population , the increasing mobility of the population . At the same time , China's regional economic development imbalances , provincial and municipal levels of imbalance between the administration of a combination of factors , resulting in the management of floating population appeared a little legal problems should be solved . Legal management of the floating population of the rule of law has become a strategic process of the difficulties and focus can be a reasonable solution to this problem , building on China's administrative system has important significance. Firstly, the various administrative departments on the concept of the floating population , characterized by a comparative analysis of knowledge , and then the floating population and foreign system requirements were studied, and then elaborated on the legal system of China's floating population management in the executive branch fragmented, mobile lack of population data information infrastructure that migrants lack legal protection of legitimate rights and interests , and other legislation related issues. For the rapid population growth in the flow occurred during the legal management issues , the author proposes improving management of floating population in the system, we must first adhere to the principle of equality , full respect for human rights ; Another thing is to establish a unified comprehensive legal regime ; against migrant inflow and outflow of population information inconsistencies raised gradually improve the proposal floating population information system , to fully protect the legitimate interests of the floating population ; finally stressed the need for law enforcement supervision migrants . Finally, this paper is closely related with the migrants temporary residence permit system , management information system, Floating Population and family planning work involved in issues related to the preliminary study . Management of floating population is the legalization of China's social development and social relations at fair value reflects the important issues on the construction of a harmonious socialist society has an important role in promoting.
