Abstract


With the pace of China's reform and opening up to further accelerate the momentum of rapid development of road transport undertakings . In order to meet the development requirements of the times , in order to strengthen and improve traffic management , in May 2004 , \entered a new historical period. But with the economic development , legislation and enforcement lag ideas need to be updated in other conflicts have become increasingly prominent , resulting in road traffic administrative dispute cases rising sharply . In this paper, city road traffic administrative cases survey to find out road traffic administrative disputes in legislation and law enforcement in the genesis , and then analyzes we should take countermeasures. This paper consists of introduction, body and conclusion composition . Body divided into three chapters are discussed : the first chapter , a city road traffic administrative lawsuits overview. This chapter focuses on analyzing 2005 city first or second instance road traffic filing administrative cases , and concluded , the trial results and other relevant data, comparing \\Chapter II , road traffic on the legislative level administrative litigation cases the causes and countermeasures. This chapter from the road transport administrative cases typical case analysis , analyzes the legislative and institutional shortcomings in legislation although not specifically relate to, but in practice caused by road traffic operating specifications administrative litigation cases. Be further from the \Chapter III , road traffic administrative enforcement proceedings the causes and countermeasures.
