Abstract


Eco-labeling system in history is not very long, but its worldwide development speed is very fast , as an international community concerned about trade-related environmental measures , has become a hot issue of international environmental law . Eco-labeling system adapted to the sustainable development and a higher standard of environmental protection requirements , but to really make the eco-labeling system complies with international law and the norms of international law concerning eco-labeling system issues in-depth study is required. International practice of eco-labeling programs are mostly built on the basis of life-cycle analysis , eco-labeling discussed in this article is mainly refers to the life cycle of signs, namely the establishment of the product life cycle based on the analysis , the product was neither manufactured by the parties , but also non-consumer third-party developed , aimed at improving the production, consumption, transportation and disposal of all aspects of the entire life cycle of environmentally friendly sign. International organizations on eco-labeling There are many definitions differ mainly on the classification of different signs . Eco-labels are mainly government has formulated and non-governmental agencies to develop and mandatory and voluntary two classifications , the world's the majority of the existing eco-labeling scheme is voluntary . Eco-labeling system is a trade-related environmental measures , both economic and legal means of dual attributes , with proof nature , authority , proprietary , timeliness and proportion of restrictive and other specific attributes. Eco-labeling system can promote environmental protection and harmonious development of international trade , but also help to protect the interests of consumers , but as more and more types of eco-labels , environmental and trade related practices play an increasingly significant impact, eco-labeling system also raises some questions , so understanding eco-labeling system and adopt an objective attitude dialectical significance of its in-depth study on the obvious . When the impact of eco-labeling system of inter-State relations, that is, when the domestic or regional eco- labeling schemes affect international trade, foreign environmental policy or international environmental and development interests, international law issues tend to produce . So the need for and the importance of eco- labeling schemes relevant international legal documents, customary international law and international judicial practice were studied , and thus analyze eco-labeling system should comply with the norms of international law , such as general exception principle , the principle of national treatment , MFN principle , the principle of transparency , the principle of unity and do not constitute barriers to trade . Only by following the norms of international law , to promote global environmental protection and are not used to limit a country 's eco other countries on their trade mark system was not constitute barriers to trade before they have legitimacy .
