Abstract

Mao Zedong's constitutional ideology has an important position in China's Constitution, the history of ideas, its theory of the regime's ideological foundation of the People's Republic of China, and a direct impact on the patterns and processes of democracy and the legal system in modern China. But academia constitutional ideology of Mao Zedong's concern is not enough, and some there are some errors. The purpose of this study is to let more people understand the constitutional ideology of Mao Zedong, in order to promote the state power in China today and democratic legal construction. The text is divided into three parts: the first part of the use of historical, legal analysis of the background and the formation process of Constitutional Thought of Mao Zedong. Improved constitutional and democratic constitutional stage that Mao Zedong Constitution thinking, was established constitutional ideology of Marxism. Mao Zedong reformist constitution thinking no systematic, the Democratic Constitution thought more mature, but incomplete. Under the guidance of Marxism, Mao Zedong, combined with China's specific national conditions, made an accurate analysis of the nature of the Constitution and the way to achieve revolutionary constitution, and ultimately the formation of the Constitution of the Marxist ideology of China. The second part of the use of historical, legal analysis, the main content of the constitutional ideology of Mao Zedong a sub-state. The third part of the constitutional ideology of Mao Zedong with the point of view of the dialectical and historical analysis. That Mao Zedong Constitution ideological and political ideology intertwined with strong times, realistic and distinctive class character and practice Embody. Mao Zedong's constitutional ideology mainly lack of practice in the period of socialist construction and the reason is elaborated and analysis, that there is no established guiding ideology of the country to the rule of law, there is no mechanism to maintain the leadership of the Constitution and not the institutionalization of democracy and legal mainly is the constitutional practice, rather the constitutional culture congenitally deficient, long-term revolutionary inertia realities formed and Mao Zedong subjective understanding of the basic conditions of social development bias and error, caused by a lack of constitutional practice.
