Abstract


Administrative public interest litigation system is the citizens, legal persons and other organizations that the administrative subject and administrative staff violate administrative litigation brought by or affect the public interest. In administrative power expanding and administrative supervision and weak today, establish the administrative public interest litigation system is very necessary to realize citizens rights. Western countries in response to demand for the development of society, has established a set of effective system of administrative public interest litigation. Our country administrative law also urged that according to the needs of public interests protection of reality, establishes the administrative public interest litigation system. Based on sufficient demonstration based on the theory of administrative public interest litigation system in China, the two big legal system country the administrative public welfare lawsuit system and the present condition of the legislation and practice of administrative public interest litigation in China is, and from the scope of accepting cases, the plaintiff qualification, other problems such as preliminary build the administrative public interest litigation system in China is discussed.
