Abstract


Following the mainline of the principle of labour rights of crews in fishboat and other concerned aspects relying on the Labour Law of PRC and the Maritime Code of PRC, and theories concerning labour rights of crews in fishboat, the paper makes a study and analysis on the issues in relation to the ascertainment and application of labour rights of crews in fishboat in China, discusses to whom the labour rights should attach and when the labour rights must attach, and disserts the labour rights in five aspects of new develepment in this area. On these bases, the paper raises constructive suggestions on the amending to the laws about labour rights of crews in fishboat and on the issues to which should be paid attention during the trial practices in China.
