Abstract


With respect to trade in goods, trade in services is a new field of the WTO multilateral trading system, adjusted by the WTO GATS (General Agreement on Trade in Services, hereinafter referred to as GATS). Financial services trade is the most important sector of trade in services. WTO trade in financial services law is an important part of the WTO legal system is the core content of the GATS. In the context of economic globalization and financial globalization, the opening of trade in financial services market has become an irresistible trend of history. WTO trade in financial services law mainly consists of the following four parts: the basic legal principles of the General Agreement of Trade in Services (GATS) Annex on Financial Services (Annex on Financial Services), \the Agreement) and the global financial services agreement reached in 1997 (Financial Service Agreement, hereinafter referred to as FSA). GATS and its Annex on Financial Services under the general principles of the adjustment of trade in financial services, a clear definition and scope of trade in financial services; \made specific commitments; Global Financial Services Agreement, the members of the party commitment to open trade in financial services in the field of concrete, reflecting the degree of financial services trade liberalization in the WTO members. After 15 years of arduous negotiations, December 11, 2001, China has finally officially became a member of the WTO. Since joining the WTO, the Chinese government in order to fulfill the WTO financial services commitments, conducted a series of amendments to China's financial services laws. However, the requirements of our existing financial services law and the WTO trade in financial services law there is still a big gap. Therefore, it is necessary to further improve the legal system of China's financial services. This paper is divided into three chapters. The first chapter reviews the generation of the legal system of the WTO trade in financial services; The second chapter describes the structure of the WTO financial services trade legal system, the main contents and characteristics; Chapter first examines the current situation and our country in the financial services legal system WTO commitments of financial services, and then summed up the WT0 our government after a number of amendments to the financial services laws, and finally the further improvement of the legal system of China's financial services put forward their own proposals.
