Abstract


The unpremeditated criminal responsibility under conclude atreaty is a special responsibility system which is proposed by German jurist YELIN in 1861. The proposal conflicted traditional concepts that no contract means no responsibility and no trot means no responsibility. Through long-years development, the system has become an independent civil responsibility, comparing to contract responsibility and trot responsibility. This paper discusses some aspects of the system , such as its developmental history, definition, legal characters, theoretical basis, components, applied range, compensative range and its progress in China. Accordingly, the author is trying to understand and hold the system in a deep level.
