Abstract


Real estate is one of the very rapid development of our pillar industries . In order to suppress the real estate market may be generated foam , the state has adopted a series of policies and strict control of the source of funding of the real estate development . To seek their own development , the real estate business in times of hardship have chosen financing model of real estate investment funds seeking a way out . The early 1960s in the United States , there has been a real estate investment fund to address the financing needs of the real estate developers . This article first real estate investment fund in the United States from the start , details the entire process of the formation and development of REITs , REITs have a significant impact on tax policy . Then the article analyzes the factor conditions , REITs must satisfy the four aspects of the structure , assets , income and distribution of basic types of REITs and gradually evolved with the development UPREIT and DOWNREIT two kinds of new structure . The Asian REITs model is established by special legislation and other forms in U.S. REITs mode based on the reference to the establishment of REITs in China , therefore , we will introduce the Asian model , and the comparative analysis of the of U.S. REITs mode with Asian REITs both exist differences. The article will be to the 1972-2001 years, the U.S. market for example the analysis of the performance of REITs stocks model focused on the relative gains between REITs and stock markets , including REITs and other financial instruments , the calendar effect and the excess return , and conclusions of the analysis to give investment advice. China has basically met the development of REITs conditions . We believe that the biggest obstacle to the development of REITs in China from the legal aspect . The article analyzes the necessity and feasibility of development of REITs in China , introduced the development status of REITs in China . Articles one by one to explore three possible models for REITs development in China , including the mode of investment trusts , real estate listed companies mode and overseas listed mode . Each mode , we will introduce the actual case , U.S. REITs compare differences exist in the four elements through each mode to identify the gap between the quasi- REITs with standard REITs . Will be based on the existing legal environment , the specific design of each of REITs development model , the analysis of each mode of advantages , disadvantages and possible legal obstacles and gives policy recommendations .
