Abstract


The police power is an indispensable part of state power and it plays an inestimable rolein maintaining public order and social security. The police power experienced great changessince it first appeared in the world. In a democratic and modern society, police should beregarded as active guards of society instead of passive night watchers. Meanwhile, the policepower is seeking to be an overwhelming power within the boundary of constitution.Developed countries as well as developing countries are now facing such new unexpectedchallenges as terrorism, separating forces, and uncontrolled social disorders in common.Without doubt, China makes no exception to those social worries. In order to deal with theseproblems effectively, responsible government should expand the exercising scope of policepower in stead of limiting it, at the same time, the police power should not be exercisedrandomly and we need to develop more appropriate procedures to guarantee its properfunction.There are an introduction and four chapters in this thesis.The first part is the introduction and it gives an overall introduction of theories and factspertaining to police power.The first chapter evaluates the exercising conditions of police power and asserts that weneed substantial expansion of police power.The second chapter explores the theories of police power expansion and its limitation.The third chapter introduces the recent development of the police power expansion ofcertain western countries.The fourth chapter makes clear what China should do to expand and regulate policepower.
