Abstract

China's accession to the WTO, due to China's agricultural subsidies irregular, resulting in other countries of agricultural subsidies, there is a misunderstanding, and that the reasons for the growth of China's agricultural exports are subject to government subsidies, thus to take countervailing and anti-dumping measures on China's agricultural exports repression. But the reality is that China's agricultural subsidies is severely lacking, resulting in substandard quality and technology of agricultural products in China, frequently by other countries \Contrast, exports of agricultural products in the United States, European Union, Japan and other big countries have adopted comprehensive agricultural support laws to strengthen agricultural subsidies, in order to ensure the international competitiveness of its agriculture. The view from the practices of these countries, to build a unified legal system of agricultural subsidies is necessary to enhance the international competitiveness of China's agricultural. In addition to the introduction, is divided into four parts: the first part, the article mainly introduced in this part of the provisions of the WTO Agreement on Agriculture on agricultural subsidies. In addition, it is important to also make the evaluation of the system of agricultural subsidies in the Agreement on Agriculture \the timing of the legislation, and to try to make the WTO agricultural negotiations later accepted our practice. The second part of the article describes the current situation of China's WTO commitments and agricultural subsidies legislation and legislative status quo on China's agricultural subsidies make evaluations, the list of existing agricultural subsidies legislation. The third part, the author due to a combination of analytical methods based on internal and external, built from four perspectives of national security, economic, legal, social discourse the need for new legislation system of agricultural subsidies. The fourth part is the main body of this paper proposed a program to build a new agricultural subsidies legal system. First, China's agricultural subsidies under the WTO framework positioning analysis, is about to build a new legislative system of agricultural subsidies should master basic principle. Second, choose legislative model of agricultural subsidies. I believe that should be the core of the Agricultural Law, and then complemented by the subsidies provisions in the specific field of agriculture, especially law, the formation of a sound legal system of agricultural subsidies. Again, it is proposed that the legal system of agricultural subsidies to build new specific measures, including amending the Agriculture Law, supporting the development of agricultural subsidies law making full use of the WTO agriculture rules allow the subsidies. Finally, a brief talk about China's agricultural anti-dumping, anti-subsidy legislation.
