Abstract


From the origin of the collective contract and in the evolution of Western history , we can see an important role in the social life of the collective contract system , and it has grown into a basic system of Western and enduring . Collective contract system in China has also been a certain period of development, but in China the status of implementation is not satisfactory . Not be able to rise to the social effects of trade unionism , collective bargaining system , some of the provisions of the collective contract , the presence or absence of the workers' right to strike and play the role of government and other relevant factors . At present, China has just joined the World Trade Organization , and also to further deepen the reform of the economic system , the need is more protective of the rights of workers , the collective contract system needs to be improved . From the concept of the collective contract , content , signed , performance , effectiveness , dispute resolution and accountability mechanisms , tried on the basis of the combination of theory and practice , in order to compare the foreign collective contract system and the existing system of domestic collective contract as an opportunity to more comprehensive collective contract were discussed. Trying to proceed from the impact of the collective contract system play a role in effectiveness in the recognition of the universal validity of the collective contract and I hope that by expanding the scope of collective bargaining body , the legislation expressly requires the establishment of trade unions the right to strike independence of the security mechanisms and the right to play the role of government , such as several aspects to gradually improve the collective contract system , in order to achieve effective protection of the rights and interests of laborers .
