Abstract


Farmers homestead rights is a fundamental right relationship between the immediate interests of the hundreds of millions of Chinese farmers . Rural practice , a large number of disputes and conflicts with the homestead rights . Provisions scarce at this stage the implementation of laws and regulations in China , content not suited to the needs of the development of the times , the lack of procedural norms . A critical period in China 's property law legislation , jurisprudence generally advocated defined as a property right, but there are large differences in specific viewpoint and method . This article argues that to be defined as self- property rights , and take this established system . This paper argues that to establish the notion that the establishment of such a system can be adapted to the needs of the market economy , and can adapt to the real right trends , can effectively protect arable land , to create the conditions for urbanization and industrialization . This from practice and theory . The first chapter of the article History from the start , combing the existing laws and regulations , and pointed out that the problems exposed by the current legal framework in the actual operation analysis of its causes . The second chapter of the recognition of farmers homestead property rights advocates to change , from the requirements of the development of the market economy , industrialization , urbanization propulsion macro aspects of the background of the times and the practical significance of this change of household registration reform , protection of arable land . Chapter further analysis of the nature of the right of homestead farmers from the historical origins of the requirements of market economy , property rights development trend , the protection of arable land , the legislative policy choice , discusses the development of urban and rural property nature of self , and analyze the pros and cons of existing several perspectives . Chapter IV from the acquisition of property rights , inheritance, transfer, elimination of several aspects of hot legal issues are analyzed and presented of some legislative suggestions .
