Abstract


Within bankruptcy liquidation, the bankruptcy property is the focus that the stakeholders care about and the core of related tasks. Due to the diversity of the bankruptcy property, the complex of the possessions and the junction of the conflicts among different stakeholders’ interests, it is decided that the study, legislation and justice of the bankruptcy property system are a difficult issue. The bankruptcy property system and its study need to deepen and the study methods need to innovate. This article through an extraordinary way of comparing, analyzing and referencing, re-saw the bankruptcy property based on the view of Law of Trust and sited the bankruptcy property as a special trust property .Based on the point above, the boundary of the bankruptcy property has been re-viewed and analyzed, the system of bankruptcy administrators and the allocation system of bankruptcy property have been reconstructed and some relevant suggestions have been looked forward to as well.
