Abstract

The limit of defense has long been the focal point of almost every case of legal defense in judicial practice. The perfection of the judging standard of the limit of defense, therefore, is not only a theoretical question, but a practical one, which will further affect judicial practice significantly. This paper is the outcome of research on the limit of legal defense, with reference to existing documents developed both home and abroad.This thesis consists 5 chapters. Start from two real cases, the foreword points out the necessity and significance of this research. In chapter one, the author gives and introduction and general discussion on the limit of legal defense. In chapter two, the author further explores the judging standards of the limit of legal defense. Based on the cases published by the Supreme People’s Court, the author comes up with suggestions to use foreign theories and legislations as reference. The last chapter is an in-depth study of "special legal defense". The conclusion section is summary of the author’s findings of this research.
