Abstract

Administrative contract has become a kind of new administrative management way widespread adopted in many countries, and this trend is to enlarge. Our government has adopted administrative contract in many relam of management. At present, academic circles of our country have done many researches in concept, nature, characteristic of administrative contract, rights and duties of administrative contract subject, fulfills of administrative contract, but in administrative contract liability, they have nearly not concerned. Researches of liability system are important to researches of a legal system, because liability system can mostly manifest the law compulsorily and can finally safeguard the implementation of this legal system. In the same time, the manifest of legal relationship litigant’s rights and duties is most obvious in liability system. Liability system can well manifest the nature and characteristic of related legal relationship, this will help us deepen our understanding of this system. Therefore, the research of administrative contract system can not separate from the examination of related responsibility system. It is necessary and practicable to conduct independent research on administrative contract liability and establish a unified standard in administrative contract liability system, simultaneously absorb related stipulations of civil contract liability and administrative responsibility.This article is for the purpose of discussing the administrative contract liability system, with the hope of officially establishmenting perfect administrative contract system in our country as soon as possible. This article altogether divides into six parts, the first part of this article is about the outline of administrative contract. Taking the English America legal system country、 France and Germany as the representatives, this part introduces the overseas administrative contract system as well as the overseas administrative contract classification. In the outline of our county’s administrative contract, this part mainly introduces the concept, the characteristic and the classification of the administrative contract The second part of this article is about the concept and essence of administrative contract liability.
