Abstract


Global warming is one of the most important issues the world must face. There are varieties of methods to acquaint and resolve environmental issues. However, Using market methods or means to seek solutions to environmental problems has caused great concern in the academic world and useful exploration has been carried out.Carbon emission right, as a concrete type right under Emission system, is a beneficial attempt of resolving environmental issues by comprehensively applying Economic means and legal means. Market-oriented trading system for carbon emissions is the primary allocation of a national’s response to climate change, protection of economic, environmental sustainable development through legal means. On this basis, through the market mechanism by using the limited environmental capacity resources to attain the optimal configuration, thus achieve the implementation and management of greenhouse gas emissions.China, as the world’s second largest carbon emitter, also faced the possibility of being taken emission reduction obligations. In Copenhagen climate summit, Chinese government has proposed an aim of 40%-50% decrease in emissions of carbon dioxide per unit of GDP from 2005 to 2020. Rather than arguing, it is better to adopt measures and take precautions to build the practical carbon emissions trading mechanism and positively deal with future emission reduction pressure. In 2010, the "Twelfth Five-Year" Plan, China clearly stated: "the carbon emissions trading market."Multiple files coping with the issue of climatic change have been published since the subscribing of "Framework Convention" and "Kyoto Protocol" and provide legal and institutional basis for China’s to build the practical carbon emissions trading mechanism. The development of science and technology and the domestic practice of carbon emissions trading right also provide technical and experience support for building carbon emissions trading right in China.The carbon emissions trading system which this paper proposed learned from the success experience of the international carbon emissions trading system and based on comprehensive consideration of the country’s political, economic, cultural, environmental conditions and other specific circumstances. In general, a progressive approach has been used. Mandatory emissions reduction zones and non-mandatory zones must have been established then expanding to the whole country. In the specific system design, the basic principles, basic rules and Governance mechanisms of carbon emissions trading system have been established to ensure the effective operation of carbon emissions trading system.
