Abstract


\The whole law is through a statutory , public basic principles designed to limit expansion of executive power , to protect the legitimate interests of the relative . But in the process of implementation of the law is still against the inevitable expansion of the executive power relative interests of the phenomenon. In order to maximize the balance of the government 's public power and private rights of the people of the conflict between the Administrative Licensing Law by establishing a hearing prior application and other systems, especially suitable for China to create a trust protection system, the fundamental purpose of these systems in order to face the huge economic interests , the relative interest in the personal property can still be guaranteed. New era gives the government new functions , but also gives a new mission Administrative Licensing Law , the Administrative Licensing Law in the specification of the socialist market economic system , to avoid unfair competition , the establishment of fair and free market environment , plays an irreplaceable role but due to various factors such that the law still has some limitations .
