Abstract


The problems of financial operation in China have been discussed for many years. But there are different focuses at different stages. In this transition period, the focus is how to regulate the phenomenon of mixed operation mode has emerged in China. And the urgent need is solving the contradiction between the existing Chinese laws and the mixed operation mode.Mixed operation and separate operation are different Classification of financial operation mode. From a historical perspective, not all financial industries have to experienced mixed operation mode or separated operation mode. There is an alternate development between mixed Operation and separated operation. They have their own strengths and weaknesses in different historical periods. And in different political, economic and legal background, they play respective roles.In the world, all countries, including China, have no "financial laws". We usually refer to that the financial laws including laws, regulations, administrative regulations, the judicial explanation and the local documents about financial.The main content of this paper is divided into four parts. Part one, Introduction. Introduction briefly explains the purpose, significance of the study, previous researches in related fields, the analytical framework, logical system and methodology of the study. Part tow is an overview of mixed operation and the financial and insurance legal system. This part describes the characteristics and modes of mixed operation, and introduces the financial and insurance legal system, then analyzes the relationship between the mixed operation and the legal system of financial and insurance. Part three, the challenge of mixed operation to the financial and insurance legal system. This section summarizes the current legal situation of separated operation in our country. On the basis of preliminary analysis, sum up the main problems and challenges the existing legal system faced. Part four, the strategies of legal system to prepare for mixed operation. This part gives some reform advances about legal system of financial and insurance, mainly in the foundation of detailed briefing on the five countries experiences.The mixed operation has been studied for many years and has various results. This paper researches from the perspective of the financial and insurance legal issues to consider mixed operation. This is not only for my personal and professional preferences, but also for the reality that day’s financial operation mode can not be separated from insurance industry. China’s insurance companies play more and more important role in the finance industry.
