Abstract


This paper studies the problem of legal regulation for illegal operation actions, illegal operation actions not only disturb the order of road transport market while violate the interests of the legal operators, but also seriously endanger the lives and property of people. Thus, it’s very necessary to research the effective regulation against it. The illegal operation actions refer to a regular practice, which is under four conditions:a) service for uncertain people; b) in the pursuit of economic profit; c) transportation operator without operation license; d) regular practice. Regulation means:Under market economy, for rectify and improve problems of market system, actions from government to manages or restricts for economic actions. Legal regulation in this paper means:Government regulates market based on law.This article starts with the well-known "Shanghai fishing enforcement" case, learn from existing research results, related to illegal operation acts regulate conduct a more in-depth study. In this paper, the methods of legal analysis of the dangers of illegal operation acts, illegal and other characteristics, the illegal operation of an accurate definition of the concept and scope; and then by literature research and survey research methods, conduct illegal operations to sort out the legal status of regulations analysis in the legislation and the difficulties faced by law enforcement; final legislative perfection from targeted, the norms of administrative law enforcement, law enforcement long The establishment of effective mechanisms and other aspects of the problem of the illegal operation of governance measures, and concerted efforts to solve the problem of illegal operation.
