Abstract


Chinese Traditional Legal Thought is the world's legal culture in the history of a dazzling pearl , an unshakable important position. Chinese Traditional Legal Thought Versatile , rich in content . \\Through the evolution of this idea will help to deepen the discussion on Chinese traditional legal thinking of knowledge and understanding. This paper is divided into three chapters. The first chapter discusses the Qing Dynasty, \contextual factors , through comparative analysis with the previous quest Qing dynasty \generation \An innovative feature of this article is not only from the ideological aspects discussed Cautious Punishment development, but also from the legislative , judicial and other macro- system performance analysis of the Qing Dynasty, \The second innovation of this article is subject to different Cautious Punishment influence attitudes and their own different forms of in-depth analysis of various factors . Cautious Punishment is a manifestation of the ancient concept of harmony , the Qing Cautious Punishment ideological and institutional aspects of the research will help deepen understanding of Chinese traditional legal culture, knowledge and understanding , in addition to China's existing criminal legislation and judicial development has an important significance and can be today, building a harmonious society to provide a reference .
