Abstract


As one of the earliest liberated big cities, Harbin established people’s democratic political power on April 28 in 1946. The protections of human rights and to protect private property ownership were the guiding ideology of civil rights in the policy programmer of Harbin. Under the leadership of the CCP and the northeast executive committee, the northeast government and Harbin government, the Harbin liberated area issued a series of relevant property, and inheritance rights and personal law. These regulations constitute prima facie the Harbin liberated areas of civil rights laws be enacted. As the first attempt of the CCP and the legal system in Harbin, the formulation of civil rights laws exist many defects. These regulations can not cover all aspects of the civil rights, we cannot solve the daily life of all civil, therefore, in the Harbin liberated areas the judicial practice, and the judge decided the civil case is based on the Chinese soviet republic of the regime of civil law, the six of the national and customs regulations about foreign nations. The civil rights laws and practice of the Harbin liberated area affected the liberation of the city and new china’s legislative and judicial construction. The civil code for the improvement of the draft and people’s livelihood are also very valuable experience and lessons.
