Abstract

The rapid development of transportation makes people’s modern production and life more convenient; meanwhile, it also brings a series of problems to the society that seriously threaten the safety of people’s lives and property. The new criminal law and judicial interpretation, the amendment of criminal law (8) .in some respects, perfect the confirmation and understanding of traffic crime, making it more convenient to implement in the judicial practice. However, the dispute over the traffic crime never stops between the theory and practice field. Based on the existing theory research, the author makes some comments on scholars’different viewpoints on the traffic crime and discusses its constitute, regarding the traffic safety as the object of the traffic accident crime. It’s the actors that violate the transportation management regulations, resulting serious traffic accidents that cause severe injuries, deaths and heavy losses of public and private property. Crime in general are the main subjects. The subjective aspect of the crime represents as negligent act. The paper also demonstrates the confirmation and understanding of escaping and deaths it causes, and discusses the basic theory of the accomplices in traffic crime and judicial interpretation of the regulations on the traffic crimes accomplices.
