Abstract


Virtual property as a new thing different from the traditional property with new features. Due to the current judicial practice in cases of violation of an endless stream of virtual property, and our legislation for the protection of property in the blank area to the healthy development of China’s Internet industry, and citizens will have the protection of virtual property, virtual property will be incorporated into the protection of criminal law is imperative. The only way to deal with cases of violations of virtual property to provide a legislative basis.This paper is divided into four chapters on the protection of virtual property to discuss the Criminal Law: The first chapter, the concept of virtual property, features, connotation and denotation were studied and discussed a definition for the virtual property; and properties of virtual property and the property legal property were discussed, analyzed the academic point of view, the draw has the property attributes of virtual property should be protected by the criminal law; second chapter, mainly on the research status of virtual property were discussed, the extraterritorial status of the legislation can be reference; third chapter, mainly criminal law protection of virtual property, the theoretical basis were discussed, affirmed the possibility of virtual property protection and the need for criminal law; fourth chapter, mainly criminal law protection of virtual property, some of the ideas of the discussion, points both for the legislative and judicial concept, hoping to provide some help for the administration of justice.
