Abstract


China’s rural credit cooperatives are an important part of the financial system. It formed by farmers voluntarily shares, and implemented democratic management. Its main function is to provide support for agriculture financial services for their members. Rural credit cooperatives serve primarily farmers, and are the subject of rural cooperative finance, credit support for agriculture of the pillars of strength. It plays an irreplaceable role in rural financial markets. It makes an important contribution for rural economic development, social stability and so on. Rural credit cooperative undergoes continuous reform since its establishment. The system in these reforms has had different changes. However, due to various reasons, it has not been effectively addressed in their position, property rights system, operation mode and management system, etc. Solve these problems directly affect the future of the rural cooperative financial or socialist economy.The article describes the history of China’s rural credit cooperatives, and the current status of the existing problems, combined with the advanced experience of foreign countries and to control the actual situation of China’s rural credit cooperatives to strengthen the legal regulation of opinion. First, the reform of rural credit cooperatives from our legislative process, analyzes the development of rural credit cooperatives and the legislative status of the different periods, the positioning of the rural credit cooperatives, functional play, and effective supervision, the focus of such reform, And further reform of rural credit cooperatives in China are analyzed with the goal of the legal basis. Secondly, the paper describes the reform of rural credit cooperatives and legal problems because these problems were analyzed. From the property rights, corporate governance, credit risk transfer mechanisms, analysis of business purpose and other aspects of the problems of rural credit cooperatives, analyze the reasons for these problems. The article also describes in detail the development of rural credit cooperatives, foreign legal system and model, in its discussion on the basis of comparative analysis of our Country. Pointed out that at this stage of the process of reform of rural credit cooperatives to establish a comprehensive cooperative financial organization system, level of powers and responsibilities of specific financial institutions, a sound system of democratic management organizations, improve the efficient cooperation in the financial capital transfers and clearing systems. In the end to perfect the legal reform of rural credit cooperatives in China thinking point of view were discussed, analyzed and summarized the experience of the reform of rural credit cooperatives, rural credit cooperatives reform put forward a sound legal thinking and advice. In order to promote the deepening of the reform of rural credit cooperatives and start a new chapter in the development of cooperative finance, called for establishment of "cooperative finance law," rural cooperative financial institutions to clear the legal status.
