Abstract


Judicial certainty is an ancient topic ,and there has been a subject of controversy for a long time.In different period,different schools there have different views and opinions about judicial certainty.Self-owned judicial activities since uncertainty is people in judicial legal activities in the life the basic goal of pursuit. In different times people never give up on the judicial deterministic pursuit.The article is divided into six parts, namely the preface and ending and the main part of the thesis four chapters in part,the author introduction: instructions choose judicial deterministic problems and the causes of the full text of argumentation way metasomatism configuration of preface sections of other than make a brief summary. The first chapter through exploring the certainty of legal philosophy meaning, to further define the judicial deterministic connotation.The second chapter around different historical periods of every school,expounds the judicial deterministic debate this issue of historical development process. The third chapter elaborated judicial a deterministic reason,and discusses the influence of various factors judicial certainty.The end chapter in based on the basis of front chapters, and combining with China’s judicial practice, put forward in China realizes judicial deterministic conception.
