Abstract


The International Sale of Goods business , buyers and sellers have to face a variety of risks . The International Sale of Goods , Transfer of risks related to the vital interests of both buyers and sellers , national laws , international conventions and international practice the issue of the transfer of risk to make specific provisions , in order to clear risk transfer and legal consequences . View of the the risk transfer relevant provisions of the international sale of goods from the domestic legislation of States , international conventions and international practice , mainly reflected the principle of three types of risk transfer , risk transfer at the time when the contract principle , the risk with the principle of the transfer of ownership , with the delivery of the risk transfer principle . Which , with the delivery of risk transfer principle the adoption of the majority of national laws and international conventions . Due to the provisions of national legislation , international conventions and international practice of risk transfer there is a difference in practical application easily lead to differences of practical significance to study the risk transfer issues in the international sale of goods . This article aims to combine the theory of risk transfer , a comparative analysis of the risk transfer provisions in the national legislation , international conventions and international practices , in order to put forward suggestions for improvement on the international sale of goods risk transfer system . Firstly, the \And then through the transfer of risk principles theoretical analysis , to explore the pros and cons of the different risk transfer principle . On this basis , comparative analysis of different laws and regulations , combined with the specific case of the legal application of risk transfer risk transfer under certain circumstances specified . Finally, the combination of the above analysis, the recommendations put forward a sound risk transfer provisions of the United Nations on Contracts for the International Sale of Goods Convention .
