Abstract


The interests of a third party contract under the open economy , the product of autonomy of the parties to the contract , there is conducive to the protection of the interests of the third party to achieve cost savings , but the principle of relativity of the contract can not be successfully implemented . From Roman law to the the contemporary countries to the Civil Code and other civil legislation , it is conducive to the third party contract system has experienced a continuous improvement process from standstill to license . Two Schools national laws recognize the interests of a third party in the general sense of the contract . Learn from the Two Schools countries experience in contract law , it is imperative to establish a general sense of the interests of a third party contract system . This paper analyzes the basis of the interests of a third party contract , to explore the validity of the contract of the interests of a third person , and then put forward legislative proposals for the interests of a third party contract .
