Abstract


The most difficult matter of the world, is not the lawmaking but the abidance of law . The life of the law lies in that it is obeyed and carried out . The constitution is more such, if there is some unconstitutional phenomenon without any good methods to solve it would be the biggest breakage to the authority of constitution. Among them the unconstitutional regulations is a more important problem, because the regulations have widespread legal effect, the implement of an unconstitutional norm document will bring greater loss. Therefore , analyze the phenomenon of unconstitutional law is a must .This text begins with the question“why there is unconstitutional phenomenon”then analyzes current theories and classification methods, The second part discussed the present condition in China and the third part draws up the main problems of the Chinese model. At last ,the author draw a conclusion and offers several suggestions .
