Abstract


With the rapid growth of the online gaming industry , online games virtual objects related to the social harm behavior increasing number , in recent years there have been a series of online games case . This article first introduces the research significance of the topic and the research expansion method ; then start from the nearly three years the introduction of a typical jurisprudence , collected case based on its properties are divided into three broad categories of virtual objects , PW and plug through the collected a total of 14 cases of the three categories of analysis , and summarized for both defense and prosecution views as well as the final court decision , explore all over the judiciary law applies in such acts into the predicament facing the choice . Finally, the article is from the collection of online games related criminal case , analyzing the statistical data indicators . Basic views of the author of the three main types of online games related criminal case , incidental discusses the determination of the Criminal Code of the social harm Legislative matters of principle . This will combine the two disciplines of intellectual property law and criminal law knowledge , and integrated the author of these two disciplines learned law at the graduate level , starting from the collection of a large number of first-hand information on China 's criminal justice system improvement and network game the construction of the system proposed recommendations to protect the health of the online gaming industry and sustainable development in the legal level .
