Abstract


The development of economic globalization , the promotion of international capital flows . Developed countries to actively promote the liberalization of international investment to reap greater economic benefits in the world , the development of China in order to join the global economy , the development of the national economy , but also to take on foreign investment in the relatively liberal access policy . At this stage , investment liberalization and domestic law , bilateral investment treaties , multilateral investment rules under the WTO framework a significant feature . How to achieve a balance between foreign access to effective regulation and liberalization of international investment is an important issue in the current international investment law . China has initially established to regulate foreign access to the range of the way of foreign capital access , equity ratio requirement , foreign access measures and access approval , including a more comprehensive regulatory system of access to foreign capital . The host country for foreign direct investment and regulatory matters within the sovereignty of the country , does not have universal application of the National Treatment of Foreign Capital Inflow . Balance and investment liberalization and the maintenance of the relationship between the national interests to achieve the goal of national foreign access regulation , according to China's economic development and the market mechanism should self-regulation level of regulation on foreign access . China should take incremental investment liberalization , and maintain the consistency of the of foreign access policy with the country's economic policy .
