Abstract


\With China's deepening strategic rule of law , for judicial review of administrative action abstraction has been unavoidable . From the abstract of foreign judicial review of administrative acts comparative studies, the Western countries administrative acts ( including the abstract administrative acts ) widely accepted judicial scrutiny. Administrative Lawsuit range expanded several times over the administrative proceedings to establish the beginning has been a great development, but with modern China's political , economic and cultural development, in particular the level of democracy and the rule of law , human rights protection requirements , as well as big gap. For the abstract of academia into the scope of judicial review administrative acts basic consensus . But to incorporate them into the scope of judicial review , how to establish effective review mechanism to review the specific content of what should be included in the review process as well as organs, administrative organs, the relationship between the judiciary and so there is no clear conclusion. This paper attempts to the existing theoretical results based on the relative portion of the details to be discussed , and strive to have some new ideas and thoughts.
