Abstract


Public trial system is not only the part of the law in the world, but also a fundamental international norms.In our country, public trial system have gotton full attention, and now it is not only the basic principles of the procedural law, but an important constitutional principle. However, the shortcomings and deficiencies that public trial has exposed in our judicial practice is also increasingly evident.This phenomenon has lead to public distrust of justice. Therefore, in order to ensure the lawful and reasonable use of public trial, it is necessary to critically examine the public trial again, and regulate and improve the system of it. It is conducive to the realization of the criminal prosecution entities and procedural justice to guarantee of human rights and at the same time,it is conducive to improve and create the basic spirit of the law legal system with Chinese characteristics to promote the progress of the whole social system. This article studys the basic theory of the public trial firstly ,and compares and finds typical phenomenon and the lack of our current legal system secondly. Finally,in order to improve the criminal justice system , this paper puts forward some ideas to improve the public trial system.
