Abstract


Keep an eye on the world’s environmental management policies， the reclamation of wastes has become a consensus among all countries which can reduce waste pollution and ease the resource crisis. According to China’s " Reclamation of Wastes Technology Engineering The Twelfth Five‐Year Special Plan ", the reclamation of wastes usually refers to "recovery valuable materials from the solid material which has exited production link or consumption field by technology、 economic instruments and management measures as much as possible,and at the same time it must be harmless and less pollution."As a knowledge‐intensive industries and material‐intensive products’ waste materials, e‐waste is high growth, high hazard and high resource.So, the ability to properly handle and recycling is not only a environmental problem but also a resources’ problem of,moreover, it is the requirements of China’s participation in international resources’ circulation. Therefore, the comprehensive utilization of the e‐waste take a major demonstration in achieving our country’s utilization of waste resources.Through the description of the characteristics of e‐waste, this article has analysed recovery processing and the legislative status of e‐waste, and has researched the main system in the management. It is aiming at discovering the shortcomings and obstacles in the e‐waste’s legal management. What’s more, we can learn some advanced experience from some other developed countries, then we can give some advice on how to improve our recommendations. This article mainly contains three sections as below:The first chapter is the logical starting point and the background of this study. In this chapter to get the real data of field survey and literature research and case as the premise, then this chapter reproduces the present situation of e‐waste recycling in China, and analyzed the problems. Secondly, this chapter introduces the important content and characteristic of three laws, one administrative regulations and its supporting policies, three relevant administrative rules and legislation characteristic. on this basis, this chapter analysed the defect of the present system in depth.The second chapter is the focus of this article content, this chapter will view frames in the developed countries who had advanced e‐waste management experiences. The defects of e‐waste management system in China is my perspective. Analyzes the recovery mode, the performance of government responsibility and the responsibility mechanism. This chapter analyzes the experience for reference in our country, and points out the rational choice should be based on the particularity of China’s national conditions.The third chapter is conclusion. This chapter first analyzes the necessity and feasibility of perfect our country e‐waste management, It is about some recommendations for perfecting the three legal systems. Its premise is the defects of our country e‐waste management system and its thought is the relevant experiences of developed countries. Put forward some suggestions including clear the government responsibility，perfecting EPR and refactoring recycling system in China.But we have to admit that, the innocent treatment and resources is also a problem in the world due to the technical limited and high cost. Compared with the developed countries, the theoretical research and practice in our country are lagging. I just hope that this article can provide some value clues to our country.
