Abstract


Along with the deepening of reform and opening up and the rapid development of socialeconomy, public power is prone to be corruption case, multiple, suffering, it is harmful to thepeople. Not only that, but it also destroy the social stability, harmony and endangers theparty’s ruling status, distort the nature state, is related to the Party and the state of vitalimportance to the problem.The so-called public rights is namely the state power. And that public power corruptionis a ruler for graft illegal and criminal acts, it can be appeared in the personal identity ofpublic servants also as a ruling party in different nature of the country. Public powercorruption is a social and historical phenomenon, and produces a direct link between privateownership, and the emergence of countries sharing the same history. Therefore, research andanalysis the root of public power and prevention must take science reveals the law ofdevelopment of human society historical materialism as the instruction, according to the basicprinciple from the source of human society development to explore, from the socialproductive forces and production relations, the basic contradiction movement rule toinspecting, from our country’s basic national conditions. By comparing, we grasp thecharacteristics of the different stages of corruption, including public rights, so that we can seethe essence through the phenomena, on the basis of the discussion at the root of public powercorruption in China. Production relations determined by backward productivity in our country,is the economic root of public power corruption；Unsound and imperfect political system, isthe political cause of public power corruption；Decadent and backward ideology and ideologyof the exploiting classes, is the ideological root of public power corruption，one of the mostdecisive causes of the economy. Need to point out that the socialist system itself is not goingto produce the public power corruption. Accurate assurance and correct understanding ofpublic right are the root causes of corruption in our country; the purpose is to provide thebasis for prevention and control of public power corruption, and puts forward specificprevention measures for the foundation.The public power corruption of our country from the view of society has regularity, from the view of individuals is selective. We know public power corruption by its regularity,through the selection to prevention and the control of public power corruption. Selectivepower shows that there is the possibility of corruption, when there are certain conditions,possibility will be translated into reality, namely the corruption crime Therefore, we have tocreate the conditions that let the possibility of corruption of public rights into reality.Specifically, creating three levels of conditions: first, through the ideological construction toenhance civil servants combating ability; second, through the rules and regulations to preventthe blocking ability and enhance punishment deterrence by punishing the constructioncautionary ability and enhance civil servants; third, through punishing construction ability toenhance the deterrent threat of punishment behavior cautionary. Taking prevention measuresmust be in line with the nature of the people while avoiding disadvantages, the mostfundamental purpose of the corrupt elements is to get economic interests that is to obtainmoney. Therefore, in addition to the criminal punishment, to increase economic penalties andto be clear to confiscate the illegal income rather than financial penalties, economicpunishment refers to the legal property of corrupt deprivation in accordance with the law. Thisway lets thoughts corrupt people weigh the pros and cons after refusing to corruption.In short, it is necessary to promote the punishing and preventing corruptioncomprehensively, only in this way can accomplish cadres and uprightness, clean government,and political correctness.
