Abstract


Network democratic participation is an important trend in contemporary democratic and a historical characteristic. In the process of the mass democracy to the evolution of the democratic to deliberative democracy, on the one hand, network can inhibit "democratic participation in political apathy" and "problem" to strengthen citizen consciousness and public spirit, expanding democracy scope and depth of promotion of democracy, On the other hand, the network democratic participation also created a "folk management" public space, promote the formation of spontaneous order since birth, and become the democratic legal process of emerging power. However, there are the anonymity of Internet space, real-time, liquidity, diversity, freedom, and some other special attributes, there will be such as "network", "planning owing to hype" and irrational behavior etc some degree of democratic risks, even threaten democracy and the rule of law order. Therefore, Carry forward the positive function of network democratic participation, inhibit its bad tendency and strengthen its corresponding legal regulation also become a kind of inevitable choice. This paper based on the contemporary democratic development trend and the rule of law in China to appeal, the legal regulation network democratic participation is analyzed and explore ways, so as to promote the democracy and the rule of law network democratic participation function make some academic effort.
