Abstract


Commutation is important penalty implementation system which the CriminalLaw and Criminal Procedure Law set, as well as parole. Meanwhile, they areimportant parts of the People’s Court criminal trial. The commutation and parolerelate to the implementation of the criminal law and reforming criminal, relate to thesupervision order, relate to the prisoners’ personal interest. In recent years, the courtshave handled many commutation and parole cases which play a pivotal role. At thesame time, the issues of commutation and parole relate to fairness and efficiency,relate to the proper execution of the penalty, relate to judicature justice and themajesty of the law.This thesis researches commutation and parole procedures from the followingthree chapters:The first chapter analyzes the implementation of commutation and parole of YPrison in Henan Province. This part researches the application of commutation andparole cases of the Y Prison in Henan Province from the year of2008to2011, usessurvey, documentary research and the empirical analysis. Select Henan Province YPrison2008-2011commutation and parole case object of study. Use SPSS Statistics（Statistical Product and Service Solutions）establishment of a database, combinedwith the use of Excel software to assist empirical research. And analyze statistical datain the database, research the status quo of commutation and parole. Propose specificissues of commutation and parole.The second chapter analyzes the reasons the issue of commutation and paroleshows. Analyze the reasons from execution idea and evaluation system andtrack-down system. The third chapter puts forward corresponding countermeasures and suggestionson the improvement of commutation and parole procedures. Put forward somesuggestions such as changing inherent execution concept, consummating evaluationsystem, repealing proportion system and so on.
