Abstract


The Yangtze River is the harder-hit area of water traffic accident in China, and the total number of accidents happened in the river accounts for 50% to 75% of the whole country, of which there are more than half are caused by ships’overloading. As the accidents of ships’ sinking and casualties caused by overloading happen frequently, ships overloading in the Yangtze River has become an important factor which would impact the water traffic safety. Because market access of shipping is not strict, which leads to a vicious and disorderly competition, low freight rates, and plus oil prices soaring, maritime regulatory regime and many other factors, ships’ overloading always happens in the Yangtze River. The control of overloaded ships has been the difficulty of monitoring water safety in the Yangtze River. Despite years of sole rectification and long-term treatment, the effect is not ideal. Overloaded ships always revive since limelight is over, which leads to fail to reach the purpose of fundamental cure. Just relying on administrative measures by Maritime Administration, it is unable to bring ships’ overloading under control. It has become the new direction of research for anti-overloading of the transport ships by integrating the Yangtze River law enforcement resources and strengthening the comprehensive treatment of the Yangtze RiverThis article takes government regulations as main line, based on the analysis for the theory and practice of governance in the domestic and international overloaded ships (vehicles), the article analyzes the status of ships overloading in the Yangtze River from the existence reason, the main forms and the treatment difficulties of the overloaded ships, and finds the shortcomings of access to the Yangtze River shipping, tax policy, ships’ type, maritime personnel and equipment, maritime information technology, integration of water law enforcement resources and punishing corruption in the shipping area, puts forward specific suggestions and measures to achieve the purpose of comprehensive treatment to the overloaded ships in the Yangtze River and protect the healthy development of the Yangtze River shipping.This article provide relevant references for completing the comprehensive treatment of ships overloading, improving functional department’s capacity of anti-ships’ overloading and strengthen the government’s public service capacity.
