Abstract

At present, the malicious divestment phenomena of foreign enterprises occur frequently, which brings about serious economic losses to the allied enterprises of our country and hidden trouble to our country’s social stability at the same time. Behavior of foreign businessmen’s malicious divestment is a serious violation of our country’s laws. Ascertaining these responsibilities need to take legal proceedings according to international and domestic laws, but our current domestic legal system lacks laws and regulations to regulate and control foreign businessmen’s malicious divestment. we also need to improve our foreign investment laws urgently. Based on the economic analysis of the phenomenon of foreign divestment, and our current legal system to regulation and control the phenomenon of foreign malicious divestment, the paper raised the issues to promote foreign investment and improve the legal system.
