Abstract


In recent years, as a kind of criminal investigation, interception is used increasingly during the process of judicial practice. As a kind of criminal investigation, interception is a effecive tool in attacking crime, but it also voilate citizens’rights of privacy. The key of the problem lies in the lack of a clear legislation governing the use of intercepion in our country for a long time. So there are no laws to abide by on how to properly conduct and the party has no laws to abide by during the almsgiving process. Based on these factors, the use of interception has been restrict greatly in the process of judicial practice. In recent years, interception is given more and more attention, and jurists work harder in this problem. Especially when interception first appeared in the Amendment to the Criminal Procedure Law of the People’s Republic of China has been reviewed primary in the twenty-second session of the Eleventh National People’s Congress Standing Committee, it can help to further explore on the interception theroy.Based on this, the text selects the interception system as a reserch perspective. The text is divided into four parts. Firstly, introduce what is interception and the interception system. Secondly, introduce the value conflicts of interception. Thirdly, compare the interception system of Anglo-American Legal System and Continental Legal System, and conclude some common basic principles. Finally, introduce the interception system in our country.
