Abstract


The evidence of the problem is the core issue of the dispute settlement procedure rules . The trend of economic globalization and cross-border commercial disputes also will be increased, and in the way many Dispute Resolution , Arbitration convenient , confidential and executable makes it widely recognized . Evidence specification Shoji arbitration practice, there is a positive role with the parties to binding arbitration tribunal , which will help the development of China 's arbitration activities and to reduce the cost and improve the reliability of the parties to resolve the dispute in our country . However , the governing bodies of our major suppliers had no detailed written rules , there is no guidance on the question of evidence . In this paper, our existing legal system , to be discussed around several evidence in commercial arbitration , the parties agreed upon the rules of evidence of the legal effect to produce the request system the Burden of Proof , evidence of special -free rights , etc. , etc. , to study our Shoji arbitration activities the options of the construction and improvement of the rules of evidence and make recommendations for arbitration evidentiary issues raised meager .
