Abstract


The 1980s , was born in the rural stock cooperative system , along with the rapid rise of township enterprises , joint-stock cooperative system has matured . Stock cooperative system in the process from urban back to rural land shares in the form of a stock cooperative system to create a new vitality . In short, stock cooperative system from the rural development in cities and towns , now and into the rural areas , is an ever-changing , development and improvement process . The land stock cooperative system , provided that the household contract responsibility system , farmers have the right to contract with the right to use land to get yourself a dual identity of workers and shareholders is a great innovation of land property rights . Land stock cooperative system is a joint-stock cooperative system , the development of the stock cooperative system not negate all of the household contract responsibility system , but both optimized configuration . The actual study the advantages and disadvantages of both , summarizes the characteristics of the development of the new era , and then proposed legislative recommendations on how to develop joint-stock cooperative system . The focus of this article is : How good stock cooperative system development in the implementation of the household contract responsibility system under the premise ? Theory , not necessarily linked to the stock cooperative system and the household contract responsibility system ; From a practical perspective , the rural land stock cooperative system combine these two systems together . Application of this two systems , its services in the economy and society must be clear conflict with the development of the times , this is a stock cooperative system legislation difficult , reason has no legal basis . This paper is divided into five chapters , the first chapter is the introduction . Second chapter aims discusses the background of the household contract responsibility system , the development process and legal characteristics . The third chapter describes the formation of cooperative shares system , development and legal characteristics . The fourth chapter describes the stock cooperative system and the differences and relations of the household contract responsibility system , compare the pros and cons of the two systems . Summarizes the development of the shares in the cooperative process , hampered due to the shackles of the household contract responsibility system . Chapter V of the first four chapters based on the analysis of the development of the stock cooperative system , the focus of this chapter is to propose legislation recommended stock cooperative system .
