Abstract


Surrogacy, as one of artificial assistant reproduction techniques, is a new method of medical treatment of infertility. Its appearance and application make a great influence on the traditional method of reproduction of human beings, social ethics and the current legal system. At present, the national legislation on surrogacy to different attitudes, different theorists also recognize this. In 2001, the Ministry of Health promulgated the Measures for the Administration of Human Assisted Reproductive Technology forbade medical institutions and medical personnel to the surrogacy operation in any forms. However, the surrogacy has never been cut off from the source, but increasing. Therefore, how to legalize and control the surrogacy effectively becomes a complex problem which must be faced on. This article argues that a simple forbidden is not desirable; the open to a limited surrogate under the regulation of law system is the correct solution. Based on previous reasons, this article describes the basic theoretical issues about surrogacy, and then analyzes and summarizes the outstanding achievements of foreign legislation by using Comparative Legal Studies, and finally, designs some basic legislative conceptions for The Act of Surrogacy of our country.
