Abstract

The problem of the waste product has drawn wide concern worldwide.After the threetechnology revolution,the productivity of humanity has been significantly increased.After Therevolution of science&technology and the economic globalization,a geometric growthoccurred in the total amount of human production.At the same time,the materials and processof the product become more complex,waste products has become a serious problem.Toanswer this problem,a new regime called“Extended Producers Responsibility”(EPR) cameup.This regime was first put forward by some developed countries in the late20`scentury,which is a environmental polity tend to solve the waste problem.EPR extends theproducers`responsibility to the post stage of the EOLs,which modified the unreasonablephenomenon that producers do not carry responsibility at all.This regime also fills the blankof the liability by identifying the subject of disposure and recycling.This regime basedprimarily on the internalization of externalities theory, theory of corporate socialresponsibility, environmental rights theory and the theory of circular economy.Nowadays,withthe environmental problems becoming more and more severe, EPR regime has developedrapidly in some foreign countries.Developed countries,such as Germany,has taken the EPRregime into their law system by issuing some acts whose content is that producers mustrecycle the EOLs by compulsory.It`s beneficial to the development of the economy and theprotection of the environment.At present we do not have a complete EPR law in China. Although the prototype EPRsystem has proposed early,and there are some basic regulations of collecting the wasteproducts regulated in the "Solid waste pollution prevention law""Circular EconomyPromotion Law" and the "Cleaner Production Promotion Law",but these laws can notimplement in reality. In view of the the faults in the product quality law, this paper hopes toincrease the idea of EPR to put forward some suggestions to perfect our law system.This article has six parts.The introduction introduce the background of the EPR regime,Ialso analysis some research at home and abroad.Besides, this article come up with a new perspective”green quality” to study the EPR system.The second part elaborates the EPRregime.This part also puts forward a brief introduction of the EPR regime which includes thedefinition,besides,I introduce the theory of the EPR.The third part introduces the presentsituation of foreign EPR system and the enlightenment to our country.This part introduce thelaw in Germany, the EU, USA, Japan as examples, introduces the legislation and practice ofinspiration system and the enlightenment to our country.The fourth part mainly expounds thecurrent situation of extended producer responsibility system of our country, by analyzing themanifestation of EPR in our country, this part points out the deficiency and problems in thelegislation.The fifth part, combined with the view discussed above, raises a concrete way ofthe improvement of the law of quality by combining the producers`responsibility to theproducts itself,to ensure the improvement of the quality of goods.This part elaborates this ideain the following four aspects:design,package,disclosure of green information and cycle ofproducts.The design responsibility includes that the producer should design their products in agreen way,design their products under a common standard and ensure the quality of theproduct itself.The package responsibility includes that the producer should package theirproducts in a green way and use packages as less as possible.The disclosure of greeninformation responsibility requires the producer disclose the green information which shouldbe available to consumers.The cycle responsibility requires the producer cycle the EOLs onthe stage of waste products.At last,this passage also makes some suggestion to thegovernment.In the conclusion part, I make some forecasts for the EPR regime.
