Abstract


The domestic sale of real estate and property management disputes and contradictions, with related internal buildings of the residential property to distinguish the relationship between ownership and confused . \At the same time the Supreme Court interpretation of the distinction between ownership disputes over the application of law on the trial building there are also problems on the understanding and application of the imperfect legislation along with the actual situation of property relations in complex and changeable , makes the division of property ownership and define necessary . Draw on the relevant legislation in the United States , detailed discussion of residential property within a condominium property rights relationship , hoping to play a clear property ownership , and ease the role of property rights disputes and conflicts . The full text is divided into five chapters: the first chapter of Sino-US condominium ownership takes . First History of China and the United States to distinguish between all the systems , and in defining clearly the condominium concept of ownership as well as the scope of the residential property , are discussed Sino-US design specification for the relationship between ownership and related legislation and the impact on the definition of property ownership . and will eventually be condominium ownership of the object divided into four categories : proprietary part of the pure , pure common parts , agreed to share part and designated for special common parts . From Chapter II to Chapter V is the main part of each chapter from the Sino - US Law Perspective on the above four categories of object 11 is defined resolution , summed up the principle defined citing a concrete manifestation in practice , while interspersed real life, a lot of controversy in some hot issues, such as the roof platform , parking spaces and garage , green part of the property ownership , and the author's point of view . The epilogue set the tone of this research point of view , put forward in this article is based on the agreed feasibility analysis as a benchmark , and that the definition and division of any property relations should be based on the moment, specific conditions .
