Abstract


The community is the basic unit of society, is the foundation of social stability. Community self-government is to promote the city an effective form of grassroots democracy. Autonomy has a close relationship with democracy and the rule of law, democracy and the rule of law to provide protection to the autonomy. China's urban community autonomy, has experienced 50 years of development, has played an important role in the social development of various historical periods, is an important part of China's political system. Promoting community self-government for speeding up the process of democratization of the country, to improve the residents' quality of life and social management level, has important practical significance. Status of the community placed in a more prominent position in the present stage of China's social transition, the community in maintaining social stability and building a harmonious society can not be ignored. Therefore, research and analysis of community self-government under the new situation, is of great significance and far-reaching. In addition to the introduction and conclusion, is divided into four parts. The first part is the meaning of the urban community autonomy. Elaborated the concept and the origin of the community, the connotation of autonomy, the constituent elements of the community, the characteristics of the type and degree of autonomy of the community, community autonomy, autonomous legal basis for autonomous legal positioning to promote the meaning of community autonomy. The second part of our urban community autonomy exists. The autonomous mechanism-based and community hardware of our community are very weak. Highly centralized by the long-term the ruling history and the impact of the planned economic system established after the founding of New China, the social life of our country, the power of the government is too powerful, into almost all fields of social life, government functions offside serious, leading to social self-development mechanism is not perfect, the concept of dependence and serious phenomenon. Accordingly, the article pointed out that the government functions offside dislocation with the residents of the functions of the Commission; community self-government body is unknown; community intermediary organizations are not perfect; residents' self-awareness, participation mechanisms are inadequate; lack of oversight mechanisms; Community autonomous organizations needs to be strengthened at this stage of the main problems of the urban community autonomy. The third part is the analysis of the problems in the urban community autonomy. Pointed out that the relevant laws and legislation blank, the law does not specifically related systems missing is the reason for the problems, that to achieve the autonomy of the community, you need to complete legal protection only from the system level to improve in order to tackling the problem. The fourth part is to propose recommendations to improve the legal system of urban community autonomy. The legal system is a system to protect community autonomy, can not leave the legal community autonomy. Establish a sound legal system and improve the supporting system, is the premise of community autonomy, community autonomy to embark on the legal track. This paper proposes amending the urban residents of the Organic Law \To clear the autonomy of the dominant position of the Residents 'Committee, to straighten out the relationship between the Residents' Committee and Government, Community party to strengthen the power of the Residents 'Committee, redefined the task of the Residents' Committee. Increase government funding to the various expenditures into municipal financial security, and supporting the implementation of reforms to alleviate the burden of the community. In addition, the article also raised some auxiliary measures, these supplementary measures include community to strengthen party building, vigorously support communities intermediary organizations, and a sound system of participation of all people, to cultivate the basis for residents to participate in, and improve the service system of community residents.
